David’s Battle for NHS Continuing Healthcare Funding for his late mother


Paying for long term care is an emotional and financial strain for most families. However, what some families are not aware of is that there may be financial assistance available for them. If the main reason someone is receiving long term care is because of their health, they may be entitled to full funding of the care fees from the NHS. This case study explains David’s story, who fought tirelessly to secure NHS Continuing Healthcare Funding for his mum, shedding light on the challenges and eventual success in reclaiming wrongly paid fees.

In September 2012, David sought assistance to challenge the denial of NHS Continuing Healthcare Funding for his mum, who had been a resident in care in Stoke-on-Trent from August 26, 2006, to December 24, 2012. Despite the family estate being responsible for the full cost of her care, the health authority initially refused to review David’s mum’s needs, citing a previous assessment for funding.

The case presented a multi-faceted challenge, with fragmented periods of assessment and varying stages of the NHS Continuing Healthcare (CHC) process. With perseverance and strategic advocacy, Hugh James successfully reopened the case, and instructed the authorities to reconsider David’s mum eligibility for NHS Continuing Healthcare Funding.

Each stage of the process brought its own set of hurdles and after rigorous review and appeal processes, it was determined that David’s mum should have been eligible for NHS Continuing Healthcare Funding throughout her residency in care.

Hugh James was able to successful recovery of approximately £100,000 on behalf of David’s mum’s estate.
