The Court of Protection rules on gift making by attorneys and deputies have been the subject of much discussion over the past few months, not least because of the Public Guardian Practice Note: giving gifts released on 18 January 2018. Much of the discussion has generally been focused on the limits of gift giving and the risks and consequences to attorneys and deputies who make gifts, particularly to themselves.
However, the recent Court of Protection case of PBC v JMA & Ors [2018] EWCOP 19 demonstrates that the Court of Protection will sanction even the largest of gifts, in the right circumstances.
