Our client was sexually abused by her treating therapist whilst attending an inpatient drug rehabilitation unit. Proceedings were brought for personal injury damages arising from the abuse and subsequent losses against the therapy centre.
The therapy centre argued there was no knowledge of the abuse or evidence that the alleged incidents were not consensual.
We argued this was abuse of a position of trust and our client lacked capacity to consent.
The matter was settled at a joint settlement meeting.
